To join the Nuw community and to lend, borrow and swap pieces on Nuw you must first accept our terms and conditions. These terms and conditions are set up to protect borrowers, lenders, swappers and swappee and to build trust on the platform.
Your data: The personal information collected from you in the sign up process enables us to contact you in relation to The Nu Wardrobe service and the Nuw community. If you are lending, borrowing or swapping a piece we may share this information with the borrower/ lender/ swapper/ swapped iin order to arrange the borrow or swap. Definition of Lender: A lender is someone who shares their clothes with other Nu members. This share is for a limited time period and there is no monetary payment made to the lender for this.
Definition of Borrower: A borrower is someone who loans a piece from a lender for a limited time period.
Definition of Swapper: A swapper is someone who permanently swaps an item with the receiver of the swap (swappee).
Definition of Swappee: A swappee is someone who receives a permanent swap from the sender (swapper)
Definition of Token: Tokens are swap tokens which users receive in exchange for pieces they list on the Nuw app. A silver or gold token is awarded to the piece based on its condition and current retail value market.
Lender: When you upload your piece please tell us the current value of your piece (taking into consideration how old this is and how many times it has been worn). Accurately describe your piece and note any flaws or areas of slight damage. Specify how the piece should be cleaned. You will accept these terms and conditions [LINK] when you first sign up to the platform.
Borrower: When borrowing you agree to take care of the piece you are borrowing. If a piece is damaged or lost, is not cleaned using the stated method, or is not returned by the specified dates (unless alternative arrangements are made) you will pay the lender the current value of the piece. Nu will give the borrower 7 days’ notice before the money is removed from the borrower's account. It is a condition of borrowing that you accept these terms and conditions [LINK] in the checkout section when you are requesting to borrow a piece.
Swapper: When you swap a piece permanently, you agree that the piece is as described in the upload, it equals the current retail value and you are legally able to offer this piece to swap.
Swappee: Responsible to ensure the piece received is as described by the swapper and if not to report this to the sender.
Tokens: For indicative purposes only in exchange for the current retail value of a piece listed on the app by a sender. Can not be exchanged for money.

1. These Terms and Conditions
These terms and conditions (together with the documents referred to in them) (collectively, these “Terms”) set out the basis on which you may make use of The Nu Wardrobe website and app (our “Site”) as a registered user. Please read these Terms carefully before you register.
By using our Site, you indicate that you accept these Terms and that you agree to abide by them. If you do not agree to these Terms, you must not use our Site.
Our Site is operated by The Nu Wardrobe Ltd a company registered in England and Wales under registered number 11344064 headquartered at 20-22 Wenlock Road, London, N1 7GU (“Nuw”, “our” or “we”).

You should check these Terms whenever you use the Site as we amend the Terms from time to time.
We often make changes to or update the Site. This is sometimes because our services have changed, because our priorities as a business have changed, because our users’ needs have changed or for any other reason.
2. OTHER TERMS THAT MAY APPLY TO YOU
Our Privacy Policy which also applies to your use of our Site, tells you the terms on which we process the personal data that we collect from you, or that you provide to us. When you use our Site, you show that you consent to such processing and you promise that the data you give us is accurate.
If you lend pieces from our Site our Lender Conditions will apply to the loan of such piece(s).
If you borrow pieces from our Site our Borrower Conditions will apply to the borrowing of such piece(s).
If you swap pieces from our Site our Swap Conditions will apply to the swapping of such piece(s).
3. CONTRACT
These Terms govern your access to and use of our Site.
When you agree to lend, borrow or swap a piece an agreement comes into force between you and the borrower/ lender/ swapper/ swappee. Nu is not a party to the agreement between you and the borrower / lender/ swapper/ swappee.
You acknowledge and accept that when borrowing, sharing or swapping pieces, Nu shall have no responsibility or liability to you in relation to any misinformation regarding any piece and/or any loss or damage caused to any piece.
4. ACCESS TO OUR SITE
Access to our Site is permitted on a temporary basis. We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Site for business and operational reasons. We will not be liable if, for any reason, our Site is unavailable at any time. We will try to give you reasonable notice of any suspension or withdrawal.
When you register to use the Site you will choose a username and password, you must treat this information as confidential, and you must not disclose it to any other person. We have the right to disable any password, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms.
We will determine, in our discretion, whether there has been a breach of these Terms through your use of our Site. When a breach of these Terms has occurred, we may take such action as we think appropriate and may result in our taking all or any of the following actions:
immediate, temporary or permanent withdrawal of your right to use our Site;
issue of a warning to you;
legal proceedings against you resulting from the breach; and/or
disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
5. CONTENT STANDARDS
When uploading images and information (a “Contribution”) to the Site you acknowledge that the Contribution will be available on the world wide web. Before uploading anything please consider what kind of images and information you would like to share.
If you feel unsafe or intimidated at any time on the Site that you should report this immediately to us at info@thenuwardrobe.com.
The following content standards apply to any and all Contributions that you upload to the Site. The Content Standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole.
We will determine, in our discretion, whether a Contribution breaches the Content Standards.
A Contribution must:
Be accurate (where it states facts).
Be genuinely held (where it states opinions).
Comply with the law applicable in England and Wales.
A Contribution must not:
Be defamatory of any person.
Be obscene, offensive, hateful or inflammatory.
Promote sexually explicit material.
Promote violence.
Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
Infringe any copyright, database right or trade mark of any other person.
Be likely to deceive any person.
Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
Promote any illegal activity.
Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
Be likely to harass, upset, embarrass, alarm or annoy any other person.
Impersonate any person, or misrepresent your identity or affiliation with any person.
Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
Contain any advertising or promote any services or web links to other sites.
If your Contribution(s) do not meet the Content Standards your Contribution will be taken down from the Site, your account may be suspended and the matter will be reported to the police.
6. CODE OF CONDUCT
As a member of the Nu community you agree to respect all members on the Site and will not take part in any activity that bullies another member in any way.
If there are accusations of bullying made against you, your account may be suspended and the matter may be reported to the police.
If it is found that you have used the Site to bully another member you will be immediately and permanently removed from the Site.
7. OUR LIABILITY
The material displayed on our Site is provided without any guarantees, conditions or warranties as to its accuracy.
To the extent that we are unable to, by law, we do not exclude or limit our liability to you. For example we do not exclude or limit our liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
You agree that you will not use the Site for any commercial or business purposes. You also acknowledge that we won’t be liable to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
8. VIRUSES, HACKING AND OTHER OFFENCES
It is always your responsibility to configure your IT systems, computer programmes and platform to enable you to safely access our Site. You should use your own virus protection software. We cannot and therefore we do not guarantee that our Site is secure or free from bugs or viruses.
You must not:
misuse our Site by knowingly or intentionally introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful; or
attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site.
If you breach these clauses you will be guilty of committing a criminal offence under the Computer Misuse Act 1990. We will report any breaches of this paragraph to law enforcement authorities and we will at all times co-operate with and support those authorities by disclosing your identity to them. If you do breach this paragraph your right to use our Site will stop immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any Site linked to it.
9. LINKING TO OUR SITE
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it in any way whatsoever. If you do link to your home page we have a few rules. It is also really important that you do not:
establish a link in a way which suggests any form of association, approval or endorsement from us where it does not exist;
establish a link to your Site from any other website that is not owned by you;
frame our Site on any other website;
create a link to any part of our Site other than the home page.
We can and will, if we want to for any reason, withdraw linking permission without notice.
10. LINKS FROM OUR SITE
Where our Site contains links to other websites that are provided by third parties we offer these links just for information purposes. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
11. JURISDICTION AND APPLICABLE LAW
The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our Site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
12. ENTIRE AGREEMENT
These Terms and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the use of our Site.
