Lending Conditions

1. These Terms and Conditions

These terms and conditions (the “Lending Conditions”) set out the basis on which you will lend clothes via The Nuw Wardrobe website and app (our “Site”). Please read these Lending Conditions carefully before you upload pieces onto the Site.

The Lending Conditions apply to your use of the Site in addition to the Site Terms and Conditions and Privacy Policy.

By lending pieces via the Site, you indicate that you accept these Lending Conditions and that you agree to abide by them. If you do not agree to these Lending Conditions, you must not use our Site to lend pieces.

Our Site is operated by The Nuw Wardrobe Ltd a company registered in England and Wales under registered number 11344064 headquartered at 20-22 Wenlock Road, London, N1 7GU ( “Nuw”, “our” or “we”).

2. Nuw’s Role

We offer a service that facilitates the borrowing, lending and swapping of pieces between registered users.

We are not responsible for any loss or damage done to any piece that you lend using the Site.

We are not a party to the agreement between you, as the lender, and the borrower.

3. Uploading and description of lending pieces

Each time you upload an image and description of a piece onto the Site you agree that:

  1. the images provided and the description is an accurate and true reflection of the condition of the piece(s) that you are sharing on the Site;

  2. the value of the piece as stated is genuine, that it is the current value rather than the retail value and that it has been adjusted to reflect the age of the garment and the amount of times it has been worn;

  3. all information concerning the piece including the washing requirements, sizing and any other details is accurate.

4. Damage/ Loss of a piece

You recognise that the pieces being shared may be damaged or lost, if this is the case the total of the value stated on the site for the piece is the maximum sum that can be retrieved by you in respect of that piece.

In the event of any to damage to or the loss of a piece, it is your responsibility to notify Nuw who will assess the situation as described below and, where applicable, attempt collect the sum (for repair or for the piece’s value) from the relevant borrower as described below.

You agree that Nuw is not responsible for any failure by the borrower to pay any amount owed to you. Nuw is not liable for the sum of the value of the piece.

5. Procedure for reimbursement in case of damage/loss

Before the borrow takes place the borrower will be provided with the following information, based on the information provided by the lender:

  1. the required date of return of the piece;

  2. the washing and care requirements; and

  3. the location that the piece must be returned to.

Failure to return the piece

If the borrower fails to return the piece to the lender within the time period notified to the borrower and there is no reasonable explanation for any delay in returning the piece the lender will notify Nuw. Nuw will then notify the borrower and an amount equivalent to the value of the piece shall be charged to the borrower's account.

Damage to the piece

If the borrower returns the piece and it is in an unsatisfactory condition and/or is damaged, it is the lender’s responsibility to show Nuw that the damage was caused by the borrower. We advise the lender to take photographs of each piece prior to sending it to a borrower and on the pieces return. The lender must prove that the piece was returned in an unsatisfactory state by providing these pictures of the piece to Nuw.

If Nuw is satisfied that the piece was damaged by the borrower Nuw will notify the borrower and an amount equivalent to the value of the piece or the cost of repair shall be charged to the borrower's account.

Nu’s determination on these matters shall be final and binding on both parties.

Compensation to the lender

The borrower will receive 7 days’ notice before the money is taken from their account. Once Nuw has confirmed with the lender that they will be compensated the lender will be paid immediately by Nuw and Nuw will receive payment from the borrower.
