Borrowing Conditions
1. These Terms and Conditions
These terms and conditions (the “Borrowing Conditions”) set out the basis on which you can borrow clothes via The Nuw Wardrobe website and app (our “Site”). Please read these Borrowing Conditions carefully before you borrow pieces via the Site.
The Borrowing Conditions apply to your use of the Site in addition to the Site Terms and Conditions and Privacy Policy.
By borrowing pieces via the Site, you indicate that you accept these Borrowing Conditions and that you agree to abide by them. If you do not agree to these Borrowing Conditions, you must not use our Site to borrow pieces.

Our Site is operated by The Nuw Wardrobe Ltd a company registered in England and Wales under registered number 11344064 headquartered at 20-22 Wenlock Road, London, N1 7GU (“Nuw”, “our” or “we”).
2. Nuw’s Role
We offer a service that facilitates the borrowing, lending and swapping of pieces between registered users.
We are not responsible for any misinformation provided to you on the Site, your receipt of any piece borrowed via the Site and/or any loss or damage done to any piece that you borrow using the Site.
We are not a party to the agreement between you, as the borrower, and the lender.
3. Borrower’s Responsibilities
Each time you borrow a piece from a lender via the Site, you agree to:
Show respect to the Nuw community member that is lending the piece;
treat the piece carefully and with respect in line with the spirit of the Nuw service;
clean the piece (in the manner specified on the item label or as the lender has outlined on the item specifications) prior to returning it to the lender; and
return the piece to the lender within the time indicated by the lender on the accepted Borrow Request.
4. Responsibility for Loss/ Damage of Item
You agree that if you lose or damage a piece, you will be obliged to pay either the lender: (a) the value of the item (as outlined on the accepted Borrow Request); or (b) where applicable, the cost of repair.
5. Procedure for reimbursement in case of damage/loss
During the borrow request process you will be informed of:
the required date of return of the piece;
the washing and care requirements; and
the location that the piece must be returned to.
Failure to return the piece
If you fail to return the piece to the lender within the time period notified to you and there is no reasonable explanation for any delay in returning the piece the lender will notify Nuw. Nuw will then notify you and an amount equivalent to the value of the piece shall be charged to your account.
Damage to the piece
If you return a piece and it is in an unsatisfactory condition and/or is damaged it is the lender’s responsibility to show Nuw that the damage was caused by you. We suggest, however that you also take photographs of the pieces on arrival to you and prior to retuning them as these may be useful for Nu’s assessment.
If Nuw is satisfied that the piece was damaged by the borrower Nuw will notify you and an amount equivalent to the value of the piece or the cost of repair shall be charged to your account.
Nu’s determination on these matters shall be final and binding on both parties.
Payment
You will receive 7 days’ notice before the money is taken from your account.
By accepting the Borrower Conditions you authorise Nuw to take payment from your account of an amount equal to the value of any piece borrowed by you from the Site in accordance with these Borrower Conditions.
